Information on the Processing of Personal Data of Journalists

In accordance with Article 13 and Article 14 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”), we inform you that:

  1. The administrator of your personal data is USP Zdrowie sp. z o.o. with its registered office in Warsaw (02-822) at ul. Poleczki 35 (hereinafter also referred to as the “Administrator” or “USP Zdrowie”). For matters concerning the processing of personal data, you can contact us at the email address ([email protected])[[email protected]] or at the correspondence address of the Administrator’s registered office.
  2. Your personal data has been acquired directly from you through business cards you provided, presentations containing contact details, websites of your editorial staff indicating you as the contact person, and correspondence directed by you to us. Your personal data may also have been provided by you through registration in our Journalist Contact Database.
  3. We process the following categories of data: (i) identification data (first and last name); (ii) address and contact data (email address, phone number, editorial address); (iii) data about the position held (position, name of the editorial office or other media you collaborate with) and we may also process other data related to communication with you (including data concerning articles, corrections of press publications, press information of which you are an author or co-author).
  4. Your personal data will be processed for the purpose of:
    • sending press releases and information regarding the activities or products of USP Zdrowie1 and other companies from the USP Group, for whose communication policy USP Zdrowie is responsible,
    • sending responses to questions asked by you in the form of email, telephone, or written communication and maintaining communication with you (including regarding articles or press information of which you are the author or co-author),
    • corrections of press publications within the meaning of the provisions of the Act of January 26, 1984, Press Law along with its amendments, supplements, and newly adopted provisions,
    • possible establishment and pursuit of claims or protection against them.
  5. The processing of your personal data is necessary to realize the legitimate interests of the Administrator, which include direct marketing and maintaining a consistent information policy for companies within the USP Group (sending press releases and information regarding the activities or products of USP Zdrowie and other companies within the USP Group, for whose communication policy USP Zdrowie is responsible), sending responses to your inquiries in email, telephone, or written forms, and communicating with you (particularly regarding articles or press information for which you are the author or co-author), making corrections to press publications, and potentially establishing and pursuing claims or defending against them (Article 6(1)(f) GDPR), as well as performing a contract for the provision of services by electronic means (Article 6(1)(b) GDPR), provided such a contract has been concluded.
  6. In addition, we may also process your personal data based on your consent (Article 6(1)(a) of the GDPR and/or Article 10 of the Act of 18 July 2002 on the provision of services by electronic means and/or Article 172 of the Telecommunications Act of 16 July 2004 along with their amendments, supplements, and newly adopted provisions) in cases where such consent has been provided by you (including, for example, but not limited to, by handing over/leaving us business cards; providing us with your contact details to receive press releases and information regarding the activities or products of USP Zdrowie and other companies from the USP Group, whose communication policy is the responsibility of USP Zdrowie; registering in our Journalist Contact Database).
  7. In the event of such necessity, your data may be shared with entities authorized under legal regulations, particularly external IT service providers, advertising and PR agencies, and other companies within the USP Group, acting on behalf of the Administrator.
  8. Your personal data will be stored for the period necessary to achieve the purposes indicated in point 4 above, or until an objection is raised (if the basis for processing is the legitimate interest of the Administrator and if the objection is successfully raised in accordance with applicable law) or until consent is withdrawn (if the basis for processing your personal data is your consent). After this time, however, your personal data will be stored for the period required by the provisions of generally applicable law. The retention period for personal data may be extended each time by the limitation period of claims if the processing of personal data is necessary for pursuing potential claims and/or defending against such claims by the Administrator.
  9. In cases specified by applicable legal provisions, you have the right to access the content of your data and the right to rectify, delete, restrict processing, the right to data portability, the right to object (if the basis for processing is the legitimate interest of the Administrator, including reasons related to your particular situation).
  10. To the extent that the basis for the processing of personal data is consent, you have the right – at any time – to withdraw the previously given consent, whereby the withdrawal of consent will not affect the lawfulness of the processing carried out based on consent before its withdrawal.
  11. You have the right to lodge a complaint with the competent supervisory authority if you believe that the processing of your personal data violates the provisions of the GDPR.
  12. The provision of your personal data to us is voluntary, but it is necessary for the achievement of the purposes indicated above.
  13. Your personal data will not be used for profiling or automated decision-making.
